TFJ Affiliate Program Terms and Conditions

 

This Affiliate Marketing Program Terms and Conditions (the "Agreement") is entered into by and between The Freedom Journey (referred to as "Company" or "The Freedom Journey") and the affiliate participant (referred to as "Affiliate" or "You"). This Agreement sets forth the terms and conditions under which You may participate in The Freedom Journey's Affiliate Marketing Program (the "Program").

1. Definitions

1.1 "Affiliate" refers to the participant who has joined The Freedom Journey's Affiliate Marketing Program in accordance with the terms of this Agreement.

1.2 "The Freedom Journey" refers to the business operated by Prime Collaborative LLC, with its registered address at 1659 TX-46 Ste 115, PO Box 488, New Braunfels, TX 78132.

1.3 "Program" refers to The Freedom Journey's Affiliate Marketing Program, where Affiliates receive compensation for successful referrals.

2. Program Participation

2.1 Eligibility: To become an Affiliate, You must have participated in and completed The Freedom Journey's 12 Week Freedom Journey Coaching Program.

2.2 Application: You can apply to become an Affiliate by submitting an application through The Freedom Journey's official website or other designated platforms. The Company reserves the right to accept or reject any application at its sole discretion.

2.3 Independent Contractor: As an Affiliate, You agree that You are an independent contractor and not an employee, partner, or representative of The Freedom Journey. You are solely responsible for your own taxes and compliance with state and federal tax requirements.

3. Compensation

3.1 Commission Structure: Affiliates will receive a commission of 5% of the total sale amount for each closed sale resulting from their referrals. A closed sale refers to a lead who has registered for and completed payment to participate in The Freedom Journey's 12 Week Freedom Journey Coaching Program.

3.2 Payment: Commissions will be paid out monthly via PayPal transactions from The Freedom Journey's PayPal account to the Affiliate's PayPal account. Payments will be made within 10 days following the end of each calendar month.

3.3 Earnings Disclaimer: The Freedom Journey makes no guarantees or representations regarding the income or earnings potential of Affiliates. Earnings may vary based on individual efforts, referrals, and market conditions.

4. Affiliate Responsibilities

4.1 Promotion: As an Affiliate, You are responsible for promoting The Freedom Journey's 12 Week Freedom Journey Coaching Program. You may share your personal experience during the program to encourage others to join. However, You must guide leads to The Freedom Journey's owned landing page to complete an application and schedule a sales call with a Freedom Journey team member. Directing leads to submit payment via The Freedom Journey's online checkout page is strictly prohibited.

4.2 Use of Materials: You may use marketing or promotional materials provided by The Freedom Journey solely for the purpose of marketing and promoting The Freedom Journey and its products and services. Any alterations, amendments, adaptations, or translations of these materials require prior written consent from The Freedom Journey.

4.3 Trademark Usage: The Freedom Journey grants You a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use The Freedom Journey's trademarks solely for marketing and promoting The Freedom Journey and its products and services. You must comply with the trademark usage guidelines provided by The Freedom Journey in writing.

4.4 Restrictions: You may not use The Freedom Journey's trademarks in your business name, logo, branding, advertising, social media, domain names, or any other manner without prior written permission from The Freedom Journey. You are prohibited from purchasing or registering search engine or pay-per-click keywords that include The Freedom Journey's trademarks or confusing variations.

4.5 Ownership: All rights, title, and interest in The Freedom Journey's materials, trademarks, and intellectual property shall remain the exclusive property of The Freedom Journey. No rights of ownership are transferred to You under this Agreement.

5. Confidentiality

5.1 Privacy Policy: The handling and protection of confidential information and data shared by Affiliates or collected through the Affiliate Marketing Program will be governed by The Freedom Journey's Privacy Policy. You agree to adhere to the terms and conditions set forth in the Privacy Policy.

6. Term and Termination

6.1 Term: This Agreement will remain in effect until terminated by either party in accordance with its terms.

6.2 Termination: The Freedom Journey reserves the right to terminate this Agreement or suspend Your participation in the Program at any time and for any reason, including but not limited to the following:

• Misrepresentation of The Freedom Journey
• Operation without integrity
• Inactivity for over 24 months
• Failure to complete The Freedom Journey's program
• Unauthorized use of The Freedom Journey's trademarks or copyright

6.3 Amendment: The Freedom Journey reserves the right to update or modify this Agreement at any time. The updated Agreement will be effective upon posting on The Freedom Journey's official website or providing notice to You via email or other reasonable means. It is Your responsibility to review the updated Agreement. If You do not agree with the updated terms, You may terminate Your affiliation with The Freedom Journey by providing written notice within 30 days from the date of the update.

7. Limitation of Liability

7.1 Company Liability: The Freedom Journey shall have no liability for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the Program, The Freedom Journey's products and services, The Freedom Journey's trademarks, or obligations under this Agreement, even if The Freedom Journey has been advised of the possibility of such damages. The Freedom Journey's liability to You under this Agreement will be limited to the referral fees paid to You by The Freedom Journey during the six (6) month period preceding the event giving rise to the claim.

7.2 Indemnification: You agree to indemnify, defend, and hold harmless The Freedom Journey and its directors, managers, officers, owners, employees, subcontractors, and agents from any claims, demands, liabilities, or expenses arising from Your breach of this Agreement, negligence, wilful misconduct, violation of applicable laws, or infringement of third-party rights.
